PITTSBURGH, October 26, 2018 – California, the Department of Justice and the American Cable Association, USTelecom, CTIA, and NCTA – representing America’s broadband providers – have today agreed to propose a delay in federal court litigation against California’s Internet Bill (SB 822) while the D.C. Circuit Court of Appeals continues consideration of Mozilla Corporation v. Federal Communications Commission. In the meantime, California will not enforce SB 822 before that case is fully resolved. Filings are available here: (1), (2), (3), and (4).

The following statement is for attribution to the American Cable Association, USTelecom, CTIA, and NCTA:

“California’s decision not to enforce its law regulating certain portions of the Internet while the D.C. Circuit reviews the FCC’s 2017 Restoring Internet Freedom order is a win for consumers that will allow continued innovation and investment while these deliberations continue. Our companies support an open Internet, and we urge Congress to resolve this issue by passing a national framework to protect that principle for all Americans.”

About the American Cable Association: Based in Pittsburgh, the American Cable Association is a trade organization representing more than 700 smaller and medium-sized, independent companies that provide broadband, phone and video services to nearly 8 million customers primarily located in rural and smaller suburban markets across America. Through active participation in the regulatory and legislative process in Washington, D.C., ACA’s members work together to advance the interests of their customers and ensure the future competitiveness and viability of their business.
